That's a Northern Mockingbird
Eastern Phoebes would have an obviously darker head and dark eyes. You can also see the white outer retrices from below that form the distinctive white tail sides of a Northern Mockingbird. Phoebes of all sorts also dip their tails habitually and constantly when at rest...Mockingbirds do not. You can also see a bit of white in the wings.
