This is the dark-eyed form.
I've only come across these a couple of times, both this year, and I've found them in the company of White-throated sparrows and Juncos, scratching (two footed) in leaf litter in dense undergrowth with lots of briars. There has also been more than one and at least three in the mixed groups that I had found. They seem pretty tolerant of people getting somewhat close.
